Darby man charged with attempted murder
HAMILTON, Mont. (AP) -- A 74-year-old Darby man is charged with attempted
deliberate homicide and assault with a weapon after a gun was shot through the
ceiling in his living room during a drunken argument.
The Ravalli Republic reports Harold Calvin Whitley was charged Wednesday.
Darby police say Robert Carl Eiswerth said Whitley had invited Eiswerth and
his common-law wife to stay the night in his apartment in Darby. Eiswerth said
Whitley came out of his room at about 5:30 p.m. Tuesday and accused the couple of
breaking into his house. Eiswerth said Whitley pointed a gun at him and threatened
to kill him.
Eiswerth said he grabbed the barrel of the gun and pointed it up before it went off.
Deputy Prosecutor Angela Wetzsteon alleged both Whitley and Eiswerth were
intoxicated.
